Eduqat ("We") is committed to protecting the personal data of every user ("You") who accesses, visits, and/or uses platform managed by Us ("Platform") to build, design, publish, sell, or purchase training offered through the Platform (“Services”).

The Platform's privacy policy (“Privacy Policy”) s intended to help You understand how We collect, use and disclose Your information and to inform You about Your privacy rights and how the law protects You.

By visiting the Platform and/or using the Services, You are deemed to have known and agreed to the collection and use of Your personal data by Us and all the provisions as outlined in this Privacy Policy, including any updates or revisions to this Privacy Policy, which is an integral part of the terms and condition of use ("Terms of Use") and Software as Service Agreement (“SAAS Agreement”).

In the event that You use the Platform on behalf of a Legal Entity, business entity or other institution (“Institution”) You declare that You are authorized to act for and on behalf of the Institution and to make the Institution follow and be bound by this Privacy Policy.

By approving, You are deemed to have waived Your rights to claims, losses, demands, or lawsuits that may occur for the use of Your data in Our system. Please read this Privacy Policy carefully before continuing to access and use the Services.

1. CHILDREN'S PRIVACY

   You certify that You are 21 (twenty-one) years old at a minimum or have been married and not placed under guardianship ("Legal Age"). If You are below the Legal Age, We are not responsible for the input of Your personal data and We recommend that the submission of such data is monitored by Your parent/guardian.

   Personal data refers to any information relating to an identified or identifiable individual.

         We collect the Personal Data when You:

         1. create an account on the Platform, subscribe to packages, register for training, purchase training, or report problems on our Platform. For this purpose, We collect Your Personal Data which includes but is not limited to Your username, address, email address, password, date of birth, and/or phone number;
         2. participate in promotions, competitions, and/or surveys that We provide, which includes but is not limited to information on age, gender, marital status, and/or occupation;
         3. interact with Our social media pages, which includes but is not limited to Your social media account ID, profile photo, and/or other data available on Your social media account;
         4. enter into payment transactions with Us using credit cards, debit cards, checks, money orders, and/or third-party payment services. For this purpose, We will collect Your Personal Data which includes but is not limited to the billing address, phone number, payment information, including the type of payment card and the last four digits, postal code, country of origin, payment expiration date, and any email addresses used for payments; and
         5. provide other Personal Data voluntarily to access the Platform and use the Services.
      2. Personal Data Automatically Recorded

         We may collect Your Personal Data automatically when You visit and/or use the Services on Our Platform. Such data includes but is not limited to:

         1. technical information, including internet protocol address (IP Address), login information, type and version of browser used, operating system, time zone setting, and real-time geolocation;
         2. visitation info, including the time of Your activities on the Platform, a complete list of URLs visited, data records/logs, a product that You have seen or searched on the Platform transaction data, as well as the phone number or email address You used to contact Our team.
      3. Personal Data Obtained From Other Sources

         We may receive Your Personal Data from other sources, such as through public databases, financial service providers, Our partners (who have previously entered into an agreement with Us regarding sending Your Personal Data to Us, in order to assist in developing services for You) and other publicly available data sources.

   2. How We Use Your Personal Data

      We may use Your Personal Data for the following purposes:

      1. monitor the use of the Services and improve the quality of Our Services to You;
      2. manage, contact or communicate with You through telephone, messages and/or fax, email and/or postal mail or other means to set up and/or manage Your relationship with Us or Your use of Our Services, providing assistance to resolve any obstacles when You access the Platform or use the Services;
      3. provide information related to products and services including providing recommendations or information related to the content, competitions, promotions, or other information that You may be interested in;
      4. allow other users to interact and/or view Your activity on the Platform, including notifying when other users have sent private messages and/or post comments for You on the Platform;
      5. conduct market research and develop new services to provide You with a better experience that can be useful for the growth of our business;
      6. prevent, detect, investigate, and take action on transactions or activities that are suspicious and indicated to contain elements of a violation of the Terms of Use, Privacy Policy, or applicable laws and regulations; and
      7. other purposes communicated to You from time to time, as permitted by applicable laws and regulations.

      We will seek Your approval before using Your Personal Data for purposes not covered by this Privacy Policy.

   3. How We Share Your Personal Data

      We will provide access to the Personal Data of participants who register for training ("Participant Data") to Our customers who create, provide, upload or send content to the Platform ("Teachers") so that Teachers can provide training to Participant.

      We and the Teachers may use Participant Data for our respective business purposes and at any time subject to the provisions of this Privacy Policy and Terms of Use and applicable laws in the Republic of Indonesia. We and the Teachers are each responsible for the use of Participant Data. Teachers acknowledge and agree that they will comply with all applicable laws and regulations relating to the protection of the Personal Data they control.

      For the purposes as stipulated in the Terms of Use and this Privacy Policy, We may also disclose Your Personal Data to third parties including but not limited to Our subsidiaries and/or affiliated companies, vendors, business partners, consultants, marketing partners, governments, law enforcer, research institutes, and/or similar service providers in the context of marketing, repairing and optimizing Our Services as well as for other publication activities, located both inside and outside the territory of the Republic of Indonesia.

      We guarantee that there will be no borrowing, transfer, sale, or distribution of Your Personal Data to third parties outside the purpose of this Terms of Use and Privacy Policy unless requested by the court or other authorized legal institution in order to comply with legal obligations and applicable laws and regulations and/or lawful requests from such courts or institutions.

3. DATA STORAGE, CORRECTION, DELETION, AND WITHDRAWAL OF CONSENT
   1. We will store the Personal Data received in a manner that is in accordance with the applicable laws and regulations. All information that We store is in the form of encrypted data and We will make reasonable efforts to protect the confidentiality of that data. We will keep all Your Personal Data under the following conditions:
      1. You are still a user of the Platform;
      2. for at least 5 (five) years from the date You stop using the Platform; or
      3. as long as the use of the Personal Data is still in accordance with the original purpose for which the Personal Data was collected.
   2. You can repair your personal data and/or delete Your account independently through the account dashboard on the Platform.
   3. If You want to withdraw Your consent to use Your personal data, You can submit a request to Us, by attaching a statement of withdrawal along with the reasons and valid proof of identity, to be processed by Us within a reasonable time and/or in accordance with applicable laws and regulations. In the event of a withdrawal of consent, We may not be able to carry out Our obligations to You properly, and therefore any legal relationship between Us and You ends and cannot be continued.
4. COOKIES

   We may place several cookies on Your browser when You access the Platform. Cookies are small digital files that are stored on the computer or mobile device that You use to visit and/or use the Services on Our Platform. We use cookies to record Your visits, the operation of the Platform, and to count the number of visitors to the Platform, and other reasons related to Platform Services in accordance with the applicable laws and regulations.

   You can refuse the use of cookies by selecting the appropriate settings on Your device. If You reject or modify the use of cookies, You hereby realize that this choice can hinder the optimal availability of Platform services, and therefore You release Us from all risks for that choice.

5. SENSITIVE INFORMATION

   We ask You not to submit and/or disclose sensitive Personal Data, such as information related to racial or ethnic origin, political views, religion or other beliefs, health or medical condition, criminal background, and/or trade union membership, on or through the Platform. In certain cases, if disclosure of this sensitive information is necessary, We will explain how You can do this securely.

6. LIMITATION OF LIABILITY OF THE PLATFORM
   1. You are responsible for the security of Your account, by maintaining the confidentiality of Your login information in the form of an email and password, as well as other data used to access Your account;
   2. We are not responsible for the leakage of Personal Data caused by You or third parties;
   3. We are responsible for the protection and security of Personal Data in Our system, and make every reasonable effort to prevent any failure of Personal Data protection, which is purely caused by Our system. If there is a failure in such protection, We will notify You in writing within a maximum of 14 (fourteen) calendar days after the failure occurs;
   4. We are not responsible for the validity, correctness, accuracy, or completeness of the data You provide to Us; and
   5. We are not responsible for any failure or delay in carrying out the obligations in this Privacy Policy if the failure or delay is caused by force majeure. Force Majeure can be defined as any event that is not caused by the fault or negligence of either Party and occurs outside the control of a particular Party, where either Party is unable to prevent or overcome it, including but not limited to natural disasters, fires, wars, riots, demonstrations, sabotage, system failures caused by third parties, banking system failures, or any changes to laws and regulations issued by the Government and may affect Our capacity to enforce this Privacy Policy. If a force majeure occurs, We will notify You in writing within a maximum of 10 (ten) calendar days after the force majeure occurs.
7. CHANGES TO OUR PRIVACY POLICY

   We may update our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on Our Platform. If We make changes that are material at Our sole discretion, We will notify You by email, by posting a notice on Our Platform, or as required by law. Unless otherwise stated, changes to this Privacy Policy will take effect immediately from the date they are posted. By continuing to use Our Platform after changes to the Privacy Policy take effect, You agree to be bound by the Privacy Policy which has been updated from time to time.

   This Privacy Policy is made in Indonesian and English, if there is a difference between the two versions, the Indonesian version will prevail.
